What is asylum?

Asylum is a type of immigration protection that can be requested by people who enter the United States or are already in the country and have a “reasonable fear” of being persecuted in their country of origin for reasons of race, religion, nationality, membership in a social group, or political opinions.

Who can apply for asylum in the United States?

Those foreigners who have been in the United States for less than a year and who belong to a group eligible for asylum, such as those persecuted for political, religious, racial, gender, sexual orientation or social group reasons.

Duration of asylum status

Asylum status is indefinite and does not have an expiration date.

Renewal

Asylum does not need to be renewed, but the asylum seeker can apply for a work permit that must be renewed annually. However, asylum seekers have the legal right to work without needing this additional document.

Benefits of asylum for the family

Immediate relatives of the asylee may also qualify for the benefits of asylum status, including a work permit, as long as they have been included in the application, even if they are not in the United States at the time of filing.

Documents required to apply for asylum:

Birth certificate or identification of the applicant
Marriage certificate (if applicable)
Copy of passport and I-94 for all applicants (if already in the U.S.)
Three passport-sized photos with a white background for each applicant
Proof of relationship with children under 21 years of age (birth certificates, academic records, etc.)
Affidavit explaining the reasons why the applicant cannot return to his or her country of origin.
